Right to Buy

Preserved Right to Buy

If you were a tenant of North Devon District Council at the time the large scale voluntary transfer to North Devon Homes took place you may have the preserved right to buy your home, provided that you lived in an eligible property. You will also be entitled to a discount on the market value, which will be related to the number of years that you have been a tenant. Your years as a tenant of the Council will be added to your years as a tenant of North Devon Homes when calculating the discount. 

You do not have the Right to Buy if you live in:

  • Sheltered housing for the elderly
  • A property which is particularly suitable for the elderly and which has been let for occupation by a pensioner or a disabled person. North Devon Homes must obtain the confirmation of the Secretary of State before finally refusing a claim to buy this type of accommodation OR
  • You have completed a mutual exchange with another tenant whose tenancy has the Right to Acquire instead of the Preserved Right to Buy.

Right to Acquire

If you are a new tenant with North Devon Homes you may be eligible for the Right to Acquire your home.

The Right to Acquire is not the same as the Preserved Right to Buy and does not apply to all properties.

The discount available under the Right to Acquire is fixed by the Government at £10,000 for the South West.. 

There are exceptions where it is not possible to exercise the Right to Acquire, these are set by the Government and the main exception which relates to North Devon Homes is where a property  is in a rural area with a population of less than 3,000.
